Terms and Conditions of Sale for Salt Water & Chlorine Hair Protectant

1. Introduction

These Terms and Conditions ("Agreement") are entered into by and between you ("Customer," "you," or "your") and Coastal GRL PTY LTD, a company incorporated under the laws of Australia ("Company," "we," "us," or "our"). By purchasing, using, or attempting to use the Salt Water & Chlorine Hair Protectant (the "Product"), you agree to abide by this Agreement. If you do not agree to these Terms and Conditions, please refrain from purchasing or using the Product.

This Agreement also incorporates and acknowledges the Australian Consumer Law (ACL) as provided under the Competition and Consumer Act 2010 (Cth), which provides you with certain rights and protections that cannot be waived or excluded under these terms.

2. Product Information

The Salt Water & Chlorine Hair Protectant is designed to help protect hair from the damaging effects of saltwater and chlorine. The Product is sold as-is, and the Company makes no representations or warranties regarding the specific results you may achieve. Any and all descriptions, images, and product representations on our website are intended solely for informational purposes and should not be construed as guarantees of efficacy or outcomes.

3. Order and Payment

By placing an order, you are making an offer to purchase the Product subject to these Terms and Conditions. All orders are subject to availability and acceptance by Coastal GRL PTY LTD, and we reserve the right to reject or cancel any order for any reason, including but not limited to:

  • Insufficient stock availability.
  • Incorrect or invalid payment information.
  • Fraudulent or suspicious activity.

Payment must be made in full before dispatching the Product, and orders are not considered final until the payment is successfully processed. The Company is not liable for any payment issues arising from third-party services (e.g., payment gateways, banks, etc.).

4. Returns, Refunds, and Exchanges

4.1 Consumer Guarantees under Australian Consumer Law
Under the Australian Consumer Law (ACL), we are required to provide a remedy (repair, replacement, or refund) if the Product is defective or does not meet the consumer guarantees. These guarantees cannot be excluded under any circumstances. You are entitled to a remedy if the Product has a:

  • Major failure (e.g., defective, not as described, etc.).
  • Failure to perform as expected under normal use.

4.2 Return Eligibility
If you are not satisfied with your Product, Coastal GRL PTY LTD offers a return within 30 days from the date of purchase, provided the following conditions are met:

  • The Product must be in original packaging.
  • The product may be opened and used; however, refunds are assessed under our satisfaction guarantee and fair use policy, and may be declined in cases of excessive use or misuse.
  • You must provide a valid proof of purchase (e.g., receipt or order confirmation).

4.3 Refund Process
If the Product meets the return conditions, we will process a full refund of the purchase price (excluding shipping and handling fees) to your original payment method. Refunds will be processed within 7 business days after receipt and inspection of the returned Product.

4.4 Return Shipping Costs
Customers are responsible for the return shipping costs unless the Product is defective or does not meet the statutory guarantees under the ACL. The Company recommends using a tracked shipping method for returns, as we cannot be held responsible for any lost or damaged items during return shipping.

4.5 Non-Eligible Returns
Returns will not be accepted under the following circumstances:

  • The Product has been opened, used, or altered in any manner.
  • The return is initiated after the 30-day return period.
  • The Product is damaged beyond normal wear and tear or has been improperly stored.

5. Damaged or Defective Products

If you receive a damaged or defective Product, or if the Product is not as described, you may be entitled to a replacement or refund under the Australian Consumer Law (ACL). You must notify Coastal GRL PTY LTD within 7 days of receiving the Product, providing clear photographic evidence of the damage or defect.

If the defect qualifies for a remedy under the ACL, you may choose between a repair, replacement, or refund. The Company reserves the right to inspect the returned item before providing a remedy. In cases where a replacement or repair is unavailable, we will issue a full refund to the original payment method.

6. Exclusions and Limitations

6.1 No Returns on Opened Products
Due to health and safety regulations, Coastal GRL PTY LTD does not accept returns for opened or used Products unless they are found to be defective under the ACL.

6.2 Limitation of Liability
To the fullest extent permitted by law, Coastal GRL PTY LTD shall not be liable for any indirect, incidental, consequential, or special damages arising from the use, inability to use, or failure of the Product, including but not limited to any loss of profit, business interruption, or any personal injury arising from improper use of the Product. Our total liability is limited to the purchase price of the Product only.

6.3 No Warranties
Except as provided by law under the Australian Consumer Law (ACL), Coastal GRL PTY LTD makes no express or implied warranties or representations regarding the Product’s performance or suitability for any particular purpose. The Company does not guarantee the outcome of using the Product, and any representation made on our website is for informational purposes only.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any disputes arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the courts located in [Your State/Territory], Australia.

If a dispute arises, you agree to first attempt to resolve the matter through informal negotiation with Coastal GRL PTY LTD.
