Terms of Service for Salt Water & Chlorine Hair Protectant
1. Introduction
Welcome to Coastal GRL PTY LTD. These Terms of Service ("Agreement") govern your use of our website and the purchase and use of our Salt Water & Chlorine Hair Protectant (the "Product"). By accessing our website or purchasing and using our Product, you agree to comply with these Terms of Service, as well as any applicable laws and regulations. If you do not agree with these terms, you should not use our website or purchase our Product.
This Agreement also incorporates your rights under Australian Consumer Law (ACL) as provided under the Competition and Consumer Act 2010 (Cth). These consumer protections provide you with certain rights that cannot be waived or excluded by this Agreement.
2. Product Information
Our Salt Water & Chlorine Hair Protectant is designed to provide protection for hair from the damaging effects of saltwater and chlorine. While we aim to provide accurate information regarding the Product, Coastal GRL PTY LTD makes no representations or warranties about the specific results you may experience. Descriptions, images, and representations on our website are for informational purposes only and should not be interpreted as guarantees of efficacy.
3. Orders and Payment
When you place an order with Coastal GRL PTY LTD, you are submitting an offer to purchase the Product, subject to acceptance by us. All orders are subject to stock availability and acceptance by Coastal GRL PTY LTD. We reserve the right to reject or cancel any order for reasons such as:
- Insufficient stock availability.
- Incorrect or invalid payment information.
- Suspected fraudulent activity.
Your payment must be fully processed before we can dispatch the Product. Once payment is confirmed, your order will be considered final. Coastal GRL PTY LTD is not responsible for payment issues arising from third-party payment providers (e.g., payment gateways, banks, etc.).
4. Returns, Refunds, and Exchanges
4.1 Consumer Guarantees under Australian Consumer Law
Under the Australian Consumer Law (ACL), consumers are entitled to remedies, including repairs, replacements, or refunds, if the Product is defective or fails to meet consumer guarantees. These rights cannot be excluded or waived under this Agreement. You may request a remedy if the Product has a:
- Major failure (e.g., it’s defective or does not match the description).
- Failure to perform as expected when used normally.
4.2 Return Eligibility
If you are unsatisfied with your purchase, you may return the Product within 30 days from the date of purchase, provided it meets the following conditions:
- The Product must be unused and in its original, unopened packaging.
- The Product's seal must remain unbroken.
- You must provide a valid proof of purchase (e.g., receipt or order confirmation).
4.3 Refund Process
If your return is eligible, Coastal GRL PTY LTD will process a full refund to the original payment method, excluding shipping and handling fees. Refunds will be processed within 7 business days of receiving and inspecting the returned Product.
4.4 Return Shipping Costs
You are responsible for the return shipping costs unless the Product is defective or does not meet the statutory guarantees under the ACL. We recommend using a tracked shipping method when returning the Product to ensure safe delivery.
4.5 Non-Eligible Returns
Returns will not be accepted if:
- The Product has been opened, used, or altered in any way.
- The return is made after the 30-day return period.
- The Product is damaged beyond normal wear and tear.
5. Damaged or Defective Products
If you receive a damaged or defective Product, or if the Product does not match the description provided, you must notify Coastal GRL PTY LTD within 7 days of receiving the Product. We may request photographic evidence of the damage or defect.
If the Product qualifies for a remedy under the ACL, we will offer you a repair, replacement, or refund, at your choice. The Company reserves the right to inspect the returned Product before providing a remedy. In cases where a replacement or repair is unavailable, we will issue a full refund to the original payment method.
6. Exclusions and Limitations
6.1 No Returns on Opened Products
For health and safety reasons, we do not accept returns for opened or used Products unless they are defective under the Australian Consumer Law.
6.2 Limitation of Liability
To the fullest extent permitted by law, Coastal GRL PTY LTD is not liable for any indirect, incidental, consequential, or special damages resulting from the use or inability to use the Product. This includes, but is not limited to, loss of profits, business interruptions, or any personal injury caused by improper use of the Product. Our total liability is limited to the purchase price of the Product only.
6.3 No Warranties
Except as required by law under the Australian Consumer Law (ACL), Coastal GRL PTY LTD makes no other warranties or representations about the Product’s effectiveness, performance, or suitability for a specific purpose. Any claims or statements made on our website are intended for informational purposes only.
7. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Agreement will be resolved through the exclusive jurisdiction of the courts located in [Your State/Territory], Australia.
If a dispute arises, you agree to first attempt to resolve the issue through informal negotiations with Coastal GRL PTY LTD.
